THROUGH THIS WEBSITE AND THE ASSOCIATED APPLICATIONS AND SERVICES. THIS AGREEMENT GOVERNS YOUR RELATIONSHIP WITH ALLIED BITS LTD. AND USE OF THE SERVICES PROVIDED THROUGH THE WEBSITE AND THE ASSOCIATED APPLICATIONS AND SERVICES. ALLIED BITS LTD. HEREBY REQUESTS THAT YOU ACCEPT THESE TERMS OF SERVICE. YOU MAY USE THE SERVICES PROVIDED THROUGH THE WEBSITE AND THE ASSOCIATED APPLICATIONS AND SERVICES ONLY ON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN. BY USING THE SERVICES PROVIDED THROUGH THE WEBSITE AND THE ASSOCIATED APPLICATIONS AND SERVICES, YOU CONSENT TO THESE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE, DO NOT USE THE WEBSITE, APPLICATIONS, AND SERVICES.
These Terms of Service include the Privacy Policy located at https://nstamp.com/legal#privacy which is incorporated and made a part of these Terms of Service.
Acceptance of Terms of Service
These Terms of Service (the "Agreement" or "Terms of Service") is a legally-binding agreement between you, either an individual or an entity ("you" or "user"), and Allied Bits Ltd. and its affiliates operating the NStamp service ("NStamp") regarding use of the website at nstamp.com or www.nstamp.com ("Website"), the application programming interface (API) at api.nstamp.com ("API Service"), the electronic mail gateway ("Mail Service"), NStamp mobile application ("NStamp App"), the modules for integration with third-party services and networks ("Integration") and the backing services. The Website, API Service, Mail Service, NStamp App, Integration, and the backing services are collectively referred to as "NStamp Services". NStamp makes the NStamp Services, including all content, information, graphics, documents, text, and all other elements and products offered through the NStamp Services (collectively, the "Content") available for your use subject to the terms and conditions set forth in this document. By accessing and using the NStamp Services, you agree to be bound by and to accept these Terms of Service and all terms and conditions contained and/or referenced herein as well as any additional terms and conditions set forth on the Website.
If you do NOT agree to all the terms and conditions in these Terms of Service, you should NOT use the NStamp Services. If you do NOT agree to any additional specific terms which apply to particular Content or to a particular transaction concluded through the NStamp Services, then you should NOT use the part of the NStamp Services which contains such Content or through which such transactions are concluded. Also, when you use any of the current or future services or obtain any products or services, whether free of charge or for payment, provided by NStamp, you will be subject to the guidelines and conditions applicable to such products or services.
These Terms of Service may be amended by NStamp at any time upon notice provided by any of the following means: through a posting on the main page of the Website, during or after you log in into your User Account (as defined below), or by email to the address you provided when you set up your User Account. Your failure to provide or maintain accurate or current contact information in your User Account will not obviate your responsibility to comply with these Terms of Service as amended from time to time.
Please check these Terms of Service regularly to ensure that you are aware of all terms governing your use of the NStamp Services.
NStamp reserves the right to make changes or updates with respect to the Content or the format thereof at any time without notice. NStamp also reserves the right to terminate or restrict your access to the Website and NStamp Services or any portion thereof for any reason whatsoever at its sole discretion.
Description of Services
With NStamp and its services you can create digital time stamps over your data presented as computer files and have the created time stamps ("Stamp") and, optionally, files stored within the storage facilities provided by NStamp for the purpose of proving the existence of these data at a certain point of time. Each Stamp includes the time of stamping, the name or names and cryptographically strong hashes of the files being stamped, an optional description, and a cryptographically strong confirmation of all the information included in the stamp.
User Obligations
You agree to use the NStamp Services only for purposes permitted by these Terms of Service as well as any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. NSTAMP IS NOT RESPONSIBLE FOR ANY VIOLATION OF APPLICABLE LAWS, RULES, OR REGULATIONS COMMITTED BY YOU OR A THIRD PARTY AT YOUR BEHEST. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOUR USE OF THE NSTAMP SERVICES DOES NOT CONTRAVENE APPLICABLE LAWS, RULES, OR REGULATIONS. Specifically, you agree and warrant that in using the NStamp Services, your actions do not contravene the laws, rules, or regulations of (1) the country, state, or locality where you reside, or (2) the country, state, or locality where NStamp is located or operates. This includes complying with applicable export and import restrictions as well as other restrictions.
Use of Services
You agree not to access (or attempt to access) the NStamp Services by any means other than those provided by NStamp or its authorized partners. You agree not to access (or attempt to access) the NStamp Services by way of automated means unless you obtain an explicit authorization to do so from NStamp by subscribing to the corresponding payment plan, and that you will not engage in any activity that interferes with or disrupts the NStamp Services (or the servers and networks which are connected to the NStamp Services).
Further, you agree:
- to use the NStamp Services in accordance with the primary purpose of the NStamp Services;
- not to disrupt or interfere with any other user's enjoyment of the NStamp Services or affiliated or linked sites;
- not to use or attempt to use another user's User Account, password, or system;
- not to access or attempt to access any Content or User Content (as defined below), which you are not authorized to access under the terms herein;
- not to disrupt or interfere with the security of, or otherwise cause harm to the NStamp Services, Content, User Content, system resources, accounts, passwords, servers, or networks connected to or accessible through the NStamp Services or any affiliated or linked sites;
- not to post or otherwise make available to others through the NStamp Services any viruses or other harmful, disruptive, or destructive files;
- not to post or otherwise make available to others through the NStamp Services any information that violates any applicable law or regulation, or do anything that promotes the violation of any applicable law or regulation;
- not to post or otherwise make available to others through the NStamp Services any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive, including, without limitation, symbols of Communism or Nazism such as a pentagram ("star"), swastika or any other insignia associated with Communist or Nazi party or any other promotion of Communist or Nazi ideology.
Interaction with Other Users
Users may have the ability to make various information available to other users through the NStamp Services. You are solely responsible for the content you post and the effect this content causes on other users. You understand that NStamp does not inquire into the backgrounds of its users or attempt to verify its users' information. NStamp makes no representations or warranties as to the conduct of its users. However, users must act in accordance with the guidelines set forth in these Terms of Service.
User Account
You may sign up for a personalized account ("User Account") with NStamp in order to access the full range of features and functions offered by the NStamp Services. In creating your User Account, you agree to submit accurate, current and complete information about yourself and keep this information updated. NStamp reserves the right to suspend or terminate User Accounts which it suspects are used in contradiction to these Terms of Service and/or contain information that is untrue, inaccurate, not current or incomplete.
When you create your User Account, you will choose a personal, non-transferable password. User Accounts may not be "shared" or used by more than one individual. After you accept these Terms of Service and your User Account registration has been accepted by NStamp, your User Account will be established. You are solely responsible for any and all activities that occur under your User Account, whether or not such use was authorized by you.
You may also access the Service by logging in using an authorized third-party account, such as a Facebook or Google account. By doing so, you authorize NStamp to collect your personal profile information from that third party.
Note that if you opt to use your third-party social network account to log in to the Website and/or the NStamp App and use the NStamp Services or interact with other user of the Website, NStamp is able to access all of your data in connection with your social network account, including, without limitation your friends list, pictures you posted or those posted of you, businesses and stories you up-voted, places you visited, etc.
This information you provide is used for such purposes as allowing you to set up a User Account and profile, improving the content of the Service, customizing the content you see, and communicating with you about specials and new features. It is completely optional for you to engage in these activities and/or make any purchases from NStamp.
Please read our Privacy Policy located at https://nstamp.com/legal#privacy which describes how NStamp collects, uses, discloses, manages and stores your personally identifiable information ("Personal Data"). You agree and understand that you are responsible for maintaining the confidentiality of all user names, passwords, access keys, and access tokens associated with any User Account you use to access the NStamp Services. Additionally, you may not use a User Account that belongs to someone else at any time without the permission of that account holder. NStamp is not liable for any harm caused or related to the theft or misappropriation of your user name, password, access token or access key, User Content, disclosure of your user name or password, access token or access key, or your authorization of anyone else to use your user name, password, access token, or access key. However, you could be held liable for losses incurred by NStamp, another user or any third party due to misappropriation and use of your User Account. If you become aware of any unauthorized use of your User Account, please notify NStamp immediately by means listed at the end of this document.
User accounts which are not used for over twelve (12) months, may be removed from the system together with all associated information, following a 30-day advance warning. The use of an account includes logging in to the Website, API Service or NStamp App, creating a stamp of a file or files, or making a payment for the NStamp Services. Any such use of the NStamp Services interrupts and restarts the inactivity period.
User Content
User Account holders may upload data, information, and other material to be stored in and accessed through the NStamp Services ("User Content"). Each Stamp created by the NStamp Services includes certain information, such as the unique number of the stamp, the date of stamping, names, sizes and hashes of the stamped files, an optional digital signature, an optional name of the person who created the Stamp, and the hash of the listed information ("Stamp Information").
Depending on the access settings set for particular Stamps, certain information such as the description of the Stamp, the names of files covered by the Stamp, the name of the user who created the Stamp ("Stamp owner"), may be available to all users including users without User Accounts ("Public Information"), be available only to particular users ("Restricted Information"), or remain private to the Stamp owner ("Private Information"). You may also be given the option to place certain User Content or Stamp Information to third-party services, such as file storage services, social networks, or e-commerce websites using the integration mechanisms. If you choose to share User Content or Stamp Information through your third-party account, you authorize NStamp to collect your personal profile and activity information from that third party as we set out above.
Subject to these Terms of Service, your User Content and Stamp Information may be used in any manner that has been authorized by you. You acknowledge and agree that NStamp has no liability of any kind should users or third parties access your User Content, regardless of whether such User Content includes Private Information or Public Information. Furthermore, you acknowledge and agree that User Content you submit, post, or display will be viewable by other users of the NStamp Services and, potentially, through third-party services and websites.
NStamp does not own any User Content and does not monitor, edit, or disclose any information regarding you or your User Account without your prior permission, except in accordance with these Terms of Service or Privacy Policy. NStamp also does not, as a matter of practice, review, inspect, edit or monitor any User Content posted, stored, or accessed by you or any other user of the NStamp Services. However, NStamp reserves the right, solely upon its own discretion, to refuse, remove, restrict, or disable access to any User Content that NStamp learns may be illegal or may violate the terms of these Terms of Service, although it has no obligation to do so. NStamp's action or inaction to regulate content or conduct or to enforce against any potential violation of these Terms of Service by any user (or any other third party) does not waive NStamp's right to implement or not implement regulation or enforcement measures with respect to any subsequent or similar content, conduct, or potential Terms of Service violation.
NStamp does not control, is not responsible for, and makes no representations or warranties with respect to any User Content. You are solely responsible for your access to, use of and/or reliance on any User Content. You must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research, and due diligence with respect to any User Content. It is your responsibility to investigate the licensing of any User Content prior to using such User Content in any way and to ensure that your use of any such User Content complies with all applicable laws, licensing requirements and does not infringe third parties' proprietary rights. You are also responsible for any content that you post or transmit, as well as all content posted or transmitted through or by use of your User Account.
Although you retain your rights to User Content you submit, post or display on or through the Services, by submitting, posting or displaying User Content on or through the NStamp Services you grant NStamp a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, publish, transmit, display and distribute the User Content for the purpose of providing the services to you and for related activities.
You may not use the NStamp Services for storing the following types of content in the descriptions of stamps, in names of the files being stamped, in your user profile or in other publicly visible information: (1) illegal content; (2) content relating to the creation, advertising, distribution, or receipt of illegal goods or services; (3) offensive content (including, without limitation, defamatory, threatening, or pornographic content); (4) content that discloses another person's personal, confidential, or proprietary information; (5) fraudulent content; (6) malicious content such as malware or spyware; and (7) content that offers, promotes, advertises or provides links to unsolicited products or services.
Technical Support
NStamp provides technical support for users. In order to receive technical support from NStamp, the user seeking such support must request such support by contacting NStamp by means listed at the end of this document. The user should describe the nature of the problem to be resolved as well as provide information about the user. NStamp will make reasonable efforts to respond to such requests in a timely manner. The user shall cooperate with NStamp when seeking technical support services by providing information necessary to assist NStamp or requested by NStamp while diagnosing or resolving the issue. Although NStamp cannot guarantee that a technical support issue will be resolved, NStamp will make reasonable efforts to perform technical support services in a professional manner.
Information and Materials Provided By You
All materials, documents, communications, or information submitted to, sent through, or stored on the NStamp Services by you will be subject to these Terms of Service and, in particular, Privacy Policy. The security of such information is crucial to NStamp.
Term and Termination
The term of these Terms of Service ("Term") shall begin when you start using the NStamp Services and shall continue in perpetuity unless otherwise terminated by NStamp or you by written notice. NStamp reserves the right to change, suspend or discontinue the NStamp Services or any portion thereof, at any time. Without prejudice to any other rights, these Terms of Service will terminate automatically if you fail to comply with any of the limitations or other requirements described herein. Upon any termination or expiration of these Terms of Service, you must immediately cease using the NStamp Services including without limitation any use of NStamp's trademarks, trade names, copyrights, and other intellectual property.
UPON TERMINATION OF THIS AGREEMENT YOU WILL NO LONGER BE AUTHORIZED TO USE THE NSTAMP SERVICES IN ANY WAY.
Links to Other Sites and Third Party Materials
The NStamp Services may include links to other websites and/or third party products and that are not under NStamp's control (collectively, "Third Party Materials"). NStamp shall not be responsible in any way for such Third Party Materials. NStamp provides such links only for the convenience of the users of the Website and NStamp Services, and the inclusion of any link to any Third Party Materials does not imply endorsement by NStamp of the content, products and/or services of such Third Party Materials. Notwithstanding any provision to the contrary herein, nothing in these Terms of Service shall be construed as to grant you any rights or licenses with regard to such Third Party Materials or to entitle you to use such Third Party Materials.
Intellectual Property
Copyright, trademark, and all other proprietary rights in the NStamp Services, and Content (including but not limited to software, services, audio, video, text and photographs, but excluding User Content) rest with NStamp and/or its licensors. Unless otherwise specifically provided herein or authorized by NStamp in writing, all rights in the NStamp Services and Content not expressly granted herein are reserved. You agree not to copy, republish, frame, make available for download, transmit, modify, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or create derivative works based on the Content, NStamp Services, other than in conjunction with the services offered by NStamp through the NStamp Services, or through the integration with third-party sites.
NStamp hereby disclaims any rights to trademarks, service marks, trade names, logos, copyright, patents, domain names or other intellectual property interests of third parties. All intellectual property interests of third parties referenced herein, including without limitation Third Party Material, or otherwise provided on the Website or by the NStamp Services are the properties of their respective owners. NStamp disclaims any proprietary interests in the intellectual property rights other than their own.
Warranties and Disclaimers
ALL CONTENT AND/OR NSTAMP SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." NSTAMP HEREBY EXPRESSLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AS TO THE OPERATION OF THIS WEBSITE, THE NSTAMP SERVICES, OR THE CONTENT. NSTAMP DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS AS TO THE SECURITY OF THE NSTAMP APPLICATIONS, WEBSITE, SERVICES, OR CONTENT. YOU ACKNOWLEDGE THAT ANY INFORMATION SENT MAY BE INTERCEPTED IN TRANSMISSION OR OTHERWISE. NSTAMP DOES NOT WARRANT THAT THE NSTAMP APPLICATION, WEBSITE, NSTAMP SERVICES, CONTENT, OR THE SERVERS WHICH MAKE THIS WEBSITE AND NSTAMP SERVICES AVAILABLE OR ELECTRONIC COMMUNICATIONS SENT BY NSTAMP ARE FREE FROM VIRUSES OR ANY OTHER HARMFUL ELEMENTS. Except as agreed by NStamp in writing, contractors, agents, dealers or distributors of NStamp or any other third party shall not have a right to modify this limited warranty, nor to make any additional warranties.
THE USE OF THE NSTAMP SERVICES OR DOWNLOADING OR OTHER USE OF ANY PRODUCTS AND CONTENT THROUGH THE WEBSITE, API SERVICE, OR NSTAMP APP IS DONE AT YOUR OWN DISCRETION AND RISK AND WITH YOUR AGREEMENT THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM SUCH ACTIVITIES. NSTAMP ASSUMES NO LIABILITY FOR ANY COMPUTER VIRUS OR OTHER SIMILAR SOFTWARE CODE THAT IS DOWNLOADED TO YOUR COMPUTER FROM THE WEBSITE OR VIA THE API SERVICE OR NSTAMP APP OR IN CONNECTION WITH ANY SERVICES OR PRODUCTS OFFERED THROUGH THE WEBSITE, NSTAMP APP, OR INTEGRATION WITH THIRD PARTY SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM NSTAMP OR USING THE NSTAMP SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.
The NStamp Services may contain references to specific NStamp products and services that may not be available in a particular country. Any such reference does not imply or warrant that any such products or services shall be available at any time in any particular country.
You understand and agree that by using the NStamp Services, you may be exposed to content that you may find offensive, indecent or objectionable and that, in this respect, you use the NStamp Services at your own risk.
IN NO EVENT SHALL NSTAMP OR ANY OF ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, CONTRACT, REVENUE, DATA, INFORMATION OR BUSINESS INTERRUPTION), UNDER ANY THEORY OF LIABILITY, RESULTING FROM, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE THE NSTAMP SERVICES OR THE CONTENT, PRODUCTS, SERVICES, STATEMENTS OR ACTIONS OF ANY THIRD PARTY ON OR THROUGH THE NSTAMP SERVICES, ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSION OR DATA, ANY INFORMATION THAT IS SENT OR RECEIVED, OR NOT SENT OR RECEIVED, ANY FAILURE TO STORE DATA, ANY LOSS OF DATA, LOSS OR DAMAGE TO FILES, LOSS OR DAMAGE TO THE CONTENT, ANY SERVICE AVAILABLE THROUGH THE NSTAMP SERVICES THAT ARE DELAYED OR INTERRUPTED, EVEN IF NSTAMP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ANY ACTION BROUGHT AGAINST NSTAMP PERTAINING TO OR IN CONNECTION WITH THE WEBSITE AND NSTAMP SERVICES MUST BE COMMENCED AND NOTIFIED TO NSTAMP IN WRITING WITHIN ONE (1) YEAR AFTER THE DATE THE CAUSE FOR ACTION AROSE.
Some jurisdictions do not allow the exclusion of implied warranties or limitations, so the above limitations may not apply to you.
Your Warranties
YOU HEREBY WARRANT THAT: (i) ALL INFORMATION PROVIDED BY YOU TO NSTAMP IN CONNECTION WITH THE NSTAMP SERVICES IS TRUE, ACCURATE, CORRECT, AND UP TO DATE; (ii) YOU HAVE FULL POWER AND AUTHORITY TO ENTER INTO THESE TERMS OF SERVICE; (iii) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH NSTAMP; (iv) YOU WILL SEEK ALL NECESSARY GOVERNMENTAL APPROVALS REQUIRED TO EFFECTUATE THESE TERMS OF SERVICE; (v) YOU SHALL PERFORM ALL OF YOUR OBLIGATIONS UNDER THESE TERMS OF SERVICE IN ACCORDANCE WITH APPLICABLE LAWS, RULES, AND REGULATIONS; AND (vi) YOUR EDITORIAL, TEXT, GRAPHIC, AUDIOVISUAL, AND OTHER CONTENT THAT IS AVAILABLE TO USERS OF THIS WEBSITE AND NSTAMP APP AND THAT IS NOT PROVIDED BY NSTAMP DO NOT (1) INFRINGE ANY INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY, (2) CONSTITUTE DEFAMATION, LIBEL, OR OBSCENITY, (3) RESULT IN ANY CONSUMER FRAUD, PRODUCT LIABILITY, BREACH OF CONTRACT TO WHICH YOU ARE A PARTY OR CAUSE INJURY TO ANY THIRD PARTY, (4) PROMOTE VIOLENCE OR CONTAIN HATE SPEECH, (5) VIOLATE ANY APPLICABLE LAW, STATUTE, ORDINANCE, OR REGULATIONS, OR (6) CONTAIN ADULT CONTENT OR PROMOTE ILLEGAL ACTIVITIES.
Any and all items or services sent, received, downloaded, or purchased from the NStamp Services may be subject to export control regulations of the United Kingdom, the United States, or European Union (the "Acts"). Thus, no product or service may be exported or re-exported into (or be used by a national or resident of) Russian Federation, Cuba, Iraq, Libya, North Korea, Iran, Syria, or any country to which the UK, the U.S., or the EU has embargoed goods and services. By using the NStamp Services or downloading the NStamp App, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
Notice and Procedure for Making Claims of Copyright Infringement
It is NStamp policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act). If you believe that your work has been copied in a way that constitutes copyright infringement, please provide NStamp Copyright Agent with the written information specified below. (Please note that this procedure is exclusively for notifying NStamp and its affiliates that your copyrighted material has been infringed.)
- An electronic or physical signature of the copyright owner or the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed upon;
- A description of where the material that you claim is infringing is located in the NStamp Services;
- Your address, telephone number, and email address;
- A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Unlawful or Prohibited Use
You may not use the NStamp Services for any purpose that is unlawful, prohibited by these Terms of Service, or in any way interferes or attempts to interfere with the proper working of the NStamp Services. You may not use the NStamp Services in any manner that could damage, disable, overburden, or impair the NStamp Services, or that interferes with any third party's use and enjoyment of the NStamp Services. You agree that you will not use any third-party software that intercepts, "mines," or otherwise collects information from or through the NStamp Services. Indemnification
You hereby agree to indemnify and hold harmless NStamp, its affiliates, officers, directors, agents, and employees, from any expense, loss, claim, damage, fine, penalty or liability, including reasonable fees for attorneys and other professionals, payable under any judgment, verdict, court order or settlement, to the extent resulting from any claim, demand, action, suit, arbitration, or other proceeding initiated by any third party, including the assessment, claim, or demand by a governmental agency or entity, arising out of your breach of these Terms of Service.

Assignment

You, however, may not assign or delegate any rights or obligations under these Terms of Service without NStamp's prior written consent, and any unauthorized assignment and delegation by you is void and ineffective.
Service Access
If the NStamp Services are not available for any period or any time, NStamp shall not be liable. NStamp gives no warranties as to the accessibility, performance, or availability of the NStamp Services. Temporary suspension of access to the NStamp Services may occur without notice at our discretion, including without limitation in the case of repair, maintenance, system failure, or for reasons beyond our control. NStamp reserves the right to suspend the operation of the NStamp Services. You agree that neither NStamp nor its third-party providers will be liable to you in any way for the termination, suspension, interruption, delay of any services and products of these NStamp Services.
Force Majeure
NStamp will not be liable for any non-performance, delay, error, data loss or other loss caused by any events or conditions that are beyond the reasonable control of NStamp.
Agreement to Deal Electronically
All transactions with or through the NStamp Services may, at NStamp's option, be conducted and executed electronically. We may keep records of any type of communication conducted via the NStamp Services. All electronic records are deemed sent when they are properly addressed to the recipient and the record enters an information processing system outside the control of the sender or the record enters a region of an information processing system under the recipient's control. All electronic records are received when the record enters an information processing system that the recipient has designated or uses for the purpose of receiving electronic records or information of the type sent, in a form capable of being processed by that system, and from which the recipient is able to retrieve the electronic record.
Injunctive Relief
You acknowledge and agree that any violation or breach of these Terms of Service may cause NStamp immediate and irreparable harm and damages. As a result, NStamp has the right to, and may in its discretion, immediately obtain preliminary injunctive relief (including, without limitation, temporary restraining orders) and seek permanent injunctive relief regarding any violation or breach of these Terms of Service. In addition to any and all other remedies available to NStamp in law or in equity, NStamp may seek specific performance of any term in these Terms of Service.
Severability
These Terms of Service will be enforced to the fullest extent permitted by applicable law. If for any reason any provision of these Terms of Service are held to be invalid or unenforceable under applicable law to any extent, then (a) such provision will be interpreted, construed or reformed to the extent reasonably required to render the same valid, enforceable and consistent with the original intent underlying such provision and (b) such invalidity or unenforceability will not affect any other provision of this Agreement.
Governing Law
These Terms of Service shall be governed by and construed and enforced in accordance with the laws of England and Wales, without reference to conflicts of law rules and principles. This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.
NStamp does not bear any responsibility nor assumes any risks if by any reason a product or a service made available on this Website or in the Services breaches national law of any country. Those who access the NStamp Services do so at their own initiative and are responsible for compliance with their national laws.

Scope of Operations
This Privacy and Personal Data Protection Policy applies to the processing of personal data defined below which takes place on or via the website at nstamp.com or www.nstamp.com ("Website"), via the application programming interface (API) at api.nstamp.com ("API Service"), in the electronic mail gateway ("Mail Service"), in the NStamp mobile application ("NStamp App"), in the modules for integration with third-party services and networks ("Integration") and in the backing services, collectively referred to as "NStamp Services".
User Age
In general, only legally capable people are allowed to use the NStamp Services.
When it comes to the collection of personal information from children, the Children's Online Privacy Protection Act (COPPA), the GDPR or applicable national laws put parental responsibility holder ("parents") in control. The Federal Trade Commission, European Union data protection authorities, national consumer protection agencies enforce the rules, which spell out what operators of websites and online services must do to protect children's privacy and safety online. Usually, the age threshold to be considered legally capable to make transactions without authorization from the parents is 13-16 years, depending on the jurisdiction. Please remember that we have the right to verify in such cases that the consent is given by the parent him- or herself, and you can be obliged to provide us with personal data on you and/or your child which we will have to process pursuant to legal obligation to do so.
We do not specifically target our advertising anywhere to children under 13. If you know that we process data of persons under the age of legal capacity, please inform us by means listed at the end of this document. Once we verify the authority of the person sending the request, we will delete the pointed personal data instantly.
Personal Data We Process
Personal data means any information relating to an identified or identifiable natural person (also referred to as "data subject"). It may include any pieces of information allowing to identify you, regardless whether they are inserted deliberately or created automatically by your computer, smartphone or other device.
Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, reading, retrieval, use, disclosure by transmission, dissemination or another form of making the data available, reconciliation or combination, restriction, erasure or destruction.
The nature of the NStamp Services requires that some personal information is stored as long as you are using the service. We aim to keep the set of such information at a minimum, but it is technically possible for you to include any information with the data you submit to the NStamp Services.
The types of personal data collected and stored by the NStamp Services are:
- Information related to creating and maintaining a user account, specifically your email address, first and last name, the username of your choice, your country, and the date and time when the account was created. This information is stored separately from the operational data (requests, stamps, blockchain, etc.).
- Evidence information, collected and stored when a user creates an account in the NStamp Services, logs in to the Website or the NStamp App, or when a stamping request is received either from the Website, the API Service, or the Mail Service. This evidence information contains the date and time of its creation and the technical details about when and how the account creation, login, or stamping request was received. The details include HTTP request headers or email headers, depending on the type of request. The evidence information is stored separately from the operational information.
- User session records. When a user or an automated process logins using a new device, a new user session is created. A session record contains the date and time of creation of the session, the country of the client device (deducted from the IP address of the HTTP client), the client's User-Agent text if available, and the date when the session expires (ceases to be valid).
- Subscription information. If a user subscribes to a paid service plan, the information about the chosen plan and the subscription period is stored in the NStamp systems.
- A user, when submitting data for stamping, can add a description for the created stamp. Moreover, files submitted for stamping have names, and those names can contain personal information, including but not limited to the author's name or email. In both cases, inclusion of personal information into the user-provided data is a voluntary decision of a user.
Website and Data
The Website uses cookies for its operations; please, refer to the Cookie Policy for the additional details about cookies and personal information in them.
Each time a web client or the NStamp App accesses the Website or the API Service, NStamp software receives and stores the following information in so-called "web server log files":
- the IP address (internet protocol address) of the client device that accesses the Website
- the internet address of the website, from which the Website was accessed (often called "referrer URL")
- the name of the resource within the Website or the API Service endpoint that is being accessed
- date and time of access
- the so-called "user agent identification" text, as provided by the client software (usually, a browser or the NStamp App)
- the result (HTTP status code) of the operation and the size of data being transferred (if any)
Retention and Storage
Both user account data and evidence information are the critical pieces of data that help the NStamp services to perform their core function, i.e., to prove the existence of certain user-submitted data and its attribution to a certain client. They are stored as long as the user account or the stamps are present in the system. Removal of a user account also removes the stamps created by this account.
User session records exist until they expire; subsequently, they are removed from the database (this normally happens after several hours after expiration).
Subscription information is stored for the period while the subscription is effective and for 31 days after that.
Both stamp descriptions and the names of stamped files are the parts of a stamp. If a stamp is deleted, this information gets deleted as well. A stamp can be marked as "pending deletion" by the author. If the mark is not removed later, the stamp is deleted 30 days after the mark was set.
Note: a stamp made anonymously (without being authenticated) cannot be deleted using regular means by any user.
Stamp descriptions are stored together with other information describing the stamp. They can be modified or removed by the author of the stamp at any time without affecting other information of the stamp or about it.
Names of stamped files are a part of data that is cryptographically secured; as such, they cannot be altered or deleted without deleting the stamp.
Web server logs are stored for 31 days.
Email correspondence and the transcripts of other communication channels may be stored for up to three (3) years.
Certain information, including but not limited to financial records such as subscription information, may be stored for longer periods as required by law of certain jurisdictions where NStamp operates.
All information types listed in paragraphs A-E of the previous section are kept in the databases, which are stored on the hardware rented by NStamp from the hosting provider and managed by this hosting provider. The databases are encrypted using the functionality built into the Database Management System. The hardware is physically located in the European Union.
The transfer of data to countries outside the European Union may take place if this is necessary to fulfil a contract, when such transfer is required by law, or where you have given us your consent. In addition, we may pass on your personal data to processors in such countries (including the IP address) given that this is permissible under articles 44–49 of GDPR given that NStamp takes additional technical and organizational measures for protecting these data.
Processors and Data Transfer
Any personal data we collect is transferred to the owner and provider of NStamp Services, Allied Bits Ltd. (office address is 20-22 Wenlock Road, London, N1 7GU, United Kingdom), operating under the NStamp trademark. NStamp is the processor and controller of your personal data.
NStamp will only transfer your personal data to third parties if this is necessary to fulfil a contract, if we or the third party have a legitimate interest in it being passed on, or if you have given your consent to this. In addition, we may pass on your personal data to the following categories of recipients who act as controllers under data protection law, to the extent this is necessary to achieve the purposes described above:
- hosting providers (currently, OVH SAS);
- Data Analysis services;
- the third parties, to which you instruct us to pass on data or give your consent. You can do this by using the functionality of the NStamp service (setting stamp permissions to public or restricted, generation and sharing of access keys for stamps, etc.) or by sending us a request by mail or other communication means;
- government authorities within the scope of their jurisdiction, if they make an explicit legally justified request. Such authorities may include police, courts, tax authorities, and similar institutions.
Use of Information
NStamp processes your personal data in accordance with the provisions of the General Data Protection Regulation (GDPR), specifically Article 6, paragraph 1. The grounds of processing personal data are:
- you have given consent to the processing of your personal data for one or more specific purposes;
- processing is necessary to fulfil a contract with you or to fulfil the pre-contractual obligations related to the public offer of service that NStamp makes;
- processing is necessary for compliance with a legal obligation to which NStamp is subject;
- processing is necessary to protect the vital interests of yours or of another natural person;
- processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in NStamp;
- processing is necessary for the purposes of the legitimate interests pursued by NStamp or by a third party, except where such interests are overridden by the interests or your fundamental rights and freedoms which require protection of personal data, in particular when pertaining to a child.
NStamp does not explicitly collect special categories of personal data defined in Article 9, paragraph 1 of GDPR (racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning your sex life or sexual orientation). If, in exceptional cases, such processing takes place (for example, when a user submits such data to the NStamp Services or sends them to NStamp), one of the following legal bases must also apply:
- you have given explicit consent to the processing of those personal data for one or more specified purposes, except where the European Union or Member State law provides that the prohibition may not be lifted by you;
- processing is necessary to protect your vital interests or such interests of another natural person where you or that person are physically or legally incapable of giving consent;
- processing relates to personal data which you manifestly made public;
- processing is necessary for the establishment, exercise, or defence of legal claims or whenever courts are acting in their judicial capacity;
- processing is necessary for reasons of substantial public interest, on the basis of Union or Member State law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.
Specific purposes of processing of your personal data are:
- Provision of a publicly accessible Website. The legitimate interest of NStamp is provision of information about the NStamp Services and making it possible to conclude a contract with NStamp in regard to using the NStamp Services.
- Collection of information about client requests sent to the Website and NStamp Services for analytical, maintenance and security-related purposes, including counteraction to various attacks. The legitimate interest of NStamp is to improve the usability of the Website and NStamp Services and to make information and services more accessible.
- Processing of enquiries and feedback from website visitors and users of the NStamp Services. The legitimate interest of NStamp is to fulfil its contractual and legal obligations and to establish business relations with visitors and users.
- Provision of the NStamp Services. Processing of personal data is required to fulfil contractual obligations.
- Collection and maintenance of email addresses for a newsletter. The legitimate interest of NStamp is to keep the email communication with you, given that you have expressed consent to keeping this communication by subscribing to the newsletter.
Your Rights Regarding Data
Where the GDPR is applicable, you are entitled to:
- access to your personal data (right to know whether your personal data is being processed, the scope of your personal data processed, and purposes of such processing as well as the duration of the processing);
- rectify the inaccurate data (you may demand the correction of the inaccurate personal data concerning you or the completion of the incomplete data about you stored by NStamp);
- erase or be forgotten without undue delay based on the grounds defined in Art.17 GDPR. Please note that not all data can be erased, and NStamp has the right to keep the data that is required by law to be stored, as well as the data that is needed to assert, exercise or defend legal claims;

restrict the processing (if the data is inaccurate, or the processing is unlawful, etc.) and "freeze" the data based on the following grounds:
- you contest the accuracy of the personal data, for a period enabling NStamp to verify the accuracy of the personal data;

- NStamp no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise, or defence of legal claims;
- you have objected to processing pursuant to Article 21(1) of GDPR pending the verification whether the legitimate grounds of NStamp override those of yours.
- data portability (you may reuse the data we collected from you pursuant to your consent across different services);
- object to processing of your personal data as detailed below;
- not to be subject to a decision based solely on automated processing without the human involvement (provided that you did not consent to automated profiling). This right does not apply to mechanisms for protection of the Website and NStamp Services from Denial of Service attacks, where the mechanisms may temporarily block access to the protected resource based on the IP address and other parameters of a request (in compliance with Article 22(2).a of GDPR);
- revoke an earlier given consent to processing of your personal data. Please note that such revocation is effective only for the future and is not applicable to processing that took place prior to revocation.
Objection to Processing
You have the right to object to processing of your personal data when such processing takes place based on the grounds of public interest (Article 6(1).e of GDPR) or for the purposes of the legitimate interests pursued by NStamp or by a third party (Article 6(1).f of GDPR).
NStamp will cease to process personal data following such an objection unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of yours or for the establishment, exercise, or defence of legal claims.

NStamp processes all personal data maintaining physical, electronic and procedural safeguards. In particular, we
- maintain physical security measures to guard against unauthorized access to systems and use safeguards such as firewalls and data encryption;
- authorize access to personal information only for those employees, contractors, or agents who require it to fulfil the responsibilities of their jobs and where it is strictly necessary;
- enter into non-disclosure agreements or include confidentiality clauses in our employment and services agreements;
- carry out malware scanning regularly;
- protect all sensitive/credit information in transit using the Transport Layer Security (SSL/TLS) technology.
If you become aware of a breach of security of your personal data processing by us and leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed, you can send us personal data breach notification using the contact information provided below. We will do our best without undue delay and where feasible consider your notification and undertake all necessary steps to notify the persons concerned and restore the security of the personal data.

The NStamp.Auth.Main cookie keeps the following information about a logged in user in encrypted and signed form (encryption and decryption take place on the server using the keys stored on the server):

Third-party Cookies
The website uses Google Analytics and related services for collecting analytical statistics about the use of the website use. These cookies are Analytical. Google Analytics is used and the corresponding cookies are set after the visitor gives consent to analytical cookies.

Trademark Guidelines
The trademarks, displayed on this site or in materials (including software products), available on this site, are the property of Allied Bits Ltd., its subsidiaries, affiliates, or other third-parties. Unauthorized duplication or use of the trademark without permission, granted by the trademark owner, is prohibited.
NStamp trademarks
Allied Bits Ltd. recognizes trademarks as a valuable asset, which distinguishes high-quality software products and services, delivered by NStamp, from other software products and services.
NStamp trademarks may be used only if permission was granted by Allied Bits Ltd.
The guidelines below define the rules when such permission is granted implicitly. In other cases, permission must be granted explicitly by Allied Bits Ltd.

Trademark Usage Guidelines
- Always use proper trademark form, capitalization, and spelling. All capitals are allowed. Don't mix case apart from as defined in trademark list. Correct: NStamp, NSTAMP. Incorrect: nstamp, nStamp, NSTAmp.
- Include an attribution of NStamp' ownership of the trademark within the credit notice section of your website, documentation, or advertisement. Put the following text where appropriate: "NStamp trademarks and logos are either registered trademarks or trademarks of Allied Bits Ltd."
- Always use the registration symbol ® for registered trademarks and TM symbol for unregistered trademarks. Using these symbols in the first sentence of the web page, advertisement or document, in which you use the trademark, is sufficient. Note, that if some part of the text includes a trademark and is used separately from the rest of the text, the first use of the trademark in this part of the text should also be marked with the specified symbol.
- Do not include NStamp trademarks into logos without explicit written permission from Allied Bits Ltd.. This includes (but is not limited to) creation of "Powered by" buttons.
- Do not create your own product names, company names, service names, which include any NStamp trademarks. Correct: Automator for NStamp. Incorrect: NStamp Automator.
- Do not create trademarks, which can be confused with NStamp trademarks. Incorrect: Nstamping.
- Do not use NStamp trademarks in domain names.
Logo Usage Guidelines
In addition to general trademark usage guidelines, the following guidelines are applied to graphic material (logos) that constitute NStamp trademarks.
- The logo should be used only when permission was granted for such use by Allied Bits Ltd.
- The logo must be used as provided by Allied Bits Ltd, without changing its contents (symbols, image parts or text), color or proportions. The logo should not be morphed, animated or in other way changed in appearance.
- The logo which constitutes a registered trademark must be accompanied by ® symbol.
- The logo may not be used without explicit permission if such use can imply that any non-NStamp products, services, websites or documents are in any way endorsed, sponsored by materials, including but not limited to goods, services, websites, or publications are sponsored, endorsed, licensed by, or affiliated with Allied Bits Ltd.
- The logo may not be used in the way that disparages Allied Bits Ltd, or its products and services, or other companies, institutions or individuals and their products and services.
- The logo must not be surrounded by or combined with any other text or graphics, if such combination can create another graphic, which can be recognized as a different logo.
- The logo must not be used as a substitution of the name of Allied Bits Ltd. as a company or its products and services including NStamp in text materials.
Third-party Trademarks
Android is a trademark of Google LLC, a subsidiary of Alphabet Inc.
Microsoft, Windows, and the Windows logo are trademarks or registered trademarks of Microsoft Corporation in the United States and/or other countries.
All other product and company names mentioned herein are the trademarks or registered trademarks of their respective owners.
ALLIED BITS LTD. RESERVES THE RIGHT TO MAKE CHANGES TO THE ABOVE GUIDELINES AS IT DEEMS NECESSARY OR APPROPRIATE.
